Conspiracy to Commit Fraud
Planned to obtain money through a fabricated class-action lawsuit based on invented abuse claims.
Situation:
"They pitch to Charlie that there are “millions to be made,” propose going after the school board, and invite him to join a class-action built on lies."
Criminal intimidation
Used threats to deter Charlie from telling police the truth, including threatening to falsely implicate him and menacing him with consequences of prison.
Situation:
"They tell Charlie to keep quiet and, if asked, say he was molested, or they’ll tell police the scheme was his idea and warn that “prison can be a bad place… for someone like you.”"
Filing a false police report
Knowingly providing false information to police and filing a police report that includes fabricated allegations (a false report of assault/rape). Making false statements to law enforcement is a crime under U.S. law (statutes vary by state).
Situation:
"The McPoyle brothers report Coach Christopher Murray for abuse they admit to Charlie did not happen; later, Charlie notes they are going to plead guilty, clearing him of involvement."
Solicitation to commit fraud (attempted)
Encouraged a scheme to falsely accuse a teacher and sue for money (stated as a ‘joke,’ not carried through).
Situation:
"The McPoyles quote Charlie proposing, “We should tell the cops that that fat dickhead gym teacher… molested us and just sue the shit out of him!” Charlie later reports the scheme to police, and the McPoyles plead guilty."
Solicitation to make false statements
Attempted to recruit Charlie to lie to investigators and in prospective legal proceedings by claiming he was abused.
Situation:
"They insist that if anyone asks him “point-blank,” he must say he was molested, and press him to join their fabricated claims."
